No Bar on Fresh Bail Application on Later Occasion: Supreme Court

The Hon’ble Supreme Court in the case of Babu Singh Vs State of Uttar Pradesh, 1978 Cr LJ 651 (SC): (1978) 2 SCR 777 : AIR 1978 SC 527 held that No Bar on Fresh Bail Application on Later Occasion , though , “ application for bail has been rejected at early stage, it does not bar fresh application on later occasion giving more details, further developments and different considerations .”

Same view has been taken by the Hon’ble Supreme Court in Kalyan Chandra Sarkar Vs. Rajesh Ranjan @ Pappu Yadav , AIR 2005 SC 921 : 2005 Cr LJ 944 : 2005 (1) Crimes 202 and by the Bombay High Court n Ganesh Vs. State of Maharashtra, 2006 ALL MR (Cri) 450. However, in State of Tamil Nadu Vs. S.A. Raja. AIR 2005 SC 4462 : 2005 Cr LJ 4640 : 2005 AIR SCW 5428, has held that fresh application within a short span of time without there being any change of circumstances is not maintainable.
