Artificial Intelligence Regulation: Lessons for India

Globally, countries have adopted diverse approaches to AI regulation. The European Union’s AI Act emphasizes a risk-based framework, categorizing AI applications as high, medium, or low risk, and mandates transparency, accountability, and human oversight for high-risk systems. The United States relies more on sectoral guidelines, with agencies like the Federal Trade Commission (FTC) addressing unfair or deceptive AI practices. China enforces stringent data governance and algorithmic accountability, particularly for AI in content moderation and surveillance. These examples demonstrate that effective AI regulation requires a combination of legal clarity, ethical standards, and enforcement mechanisms.
For India, AI regulation must consider constitutional rights and existing statutory frameworks. AI’s cross-border nature requires India to align domestic policies with international norms, including ethical AI, data sharing, and cybersecurity standards. Participation in forums like G20, OECD, and Global Partnership on AI can help India influence global regulatory frameworks while adopting best practices suitable for domestic implementation.
